Although there is no laws stating employers must provide smoking shelter facilities for employees, with the use of a dedicated external area for smoking which uses a combination of smoking canopy or porch and appropriate ash bins for litter, an employer can provide a hygenic and safe environment for thier smoking employees.

There is no requirement to provide smoking shelters. It is common for health-focused employers not to spend money creating places for smokers to congregate. If you do have an outside smoking shelter, smoking canopy, smoking porch or smoking area, you will need to be sure that it is not ‘enclosed’ or ‘substantially enclosed’ as defined by the new smoking law.
